Minutes of the UO Assembly Meeting 2 May 1984
REGULAR MEETING OF THE ASSEMBLY UNIVERSITY OF OREGON
The meeting was called to order by President Paul Olum in Room 150 Geology
at 3:37 p.m., May 2, 1984. There being no corrections, the minutes of the
April 4, 1984 meeting were approved as distributed.
ANNOUNCEMENTS
Mr. George Sheperd, Chair, Academic Requirements Committee, was recognized
to read the following motion: "That the faculty of the University of Oregon
recommends that the Oregon State Board of Higher Education confer upon
the persons whose names are included in the Official Degree List, as compiled
and certified by the University Registrar after the close of Spring term
1984, and Summer term, 1984, the degree for which they have completed all
requirements." without any dissenting votes the motion was passed by the
Assembly.
UNFINISHED BUSINESS
President Olum announced that the discussion on the definition of voting
faculty was on the floor and he requested that Mr. Sanford Tepfer, Biology,
summarize his motion on voting as it now stood. Mr. Tepfer made a brief
summary of the previous discussion (April 4 Assembly Meeting) and he read
the amendment on the floor:

"4. All librarians in the University will have the same voting rights
and privileges as the faculty on regular academic appointment."
This amendment had been amended also, Mr. Tepfer pointed out, and so he
read the amendment to the amendment:
-
"All science shop employees with the rank of instructor shall voting privileges."
In a voice vote the amendment to the amendment was defeated. The main amendment
was now on the floor. After a short discussion this amendment was accepted
by the Assembly by a vote of 21 yes and 19 no. The total motion was now
on the floor. President Olum stated that the motion would require a two
thirds vote to pass. By a vote of 37 yes and 13 no the motion to re-define
the voting faculty was accepted by the Assembly. (This re-definition is
attached to these minutes as Appendix I.) Mr. Tepfer was recognized to
present a motion to establish a quorum for the University Assembly.

"Effective at the Assembly meeting following the adoption of this motion,
the following quorum requirement will be observed:
-
1. On all actions other than approval of academic degrees, a quorum of
seventy- five (75) members of the Assembly must be present. This quorum
shall include both faculty and student members of the Assembly.

2. In an action to approve the awarding of academic degrees, there will
be no quorum required."
After a short discussion the motion was called for and President Olum ruled
that the Student University Affairs Board members of the Assembly could
not vote. This was challenged by Mr. Robin Dawes, Psychology, and was put
to a vote of the Assembly. The Assembly supported President Olum's rule.
The quorum motion failed to get the two thirds majority needed to pass.
It was defeated by a vote of 28 in favor and 24 opposed.
President Olum recognized Mr. Russell Tomlin, Linguistics, to read the
following motion:

"In the event that a non-credit SEARCH workshop covers substantially
the same grounds already covered by a class offered through an existing
academic department or program on the UO campus, the SEARCH office must
consult with the academic department or program in question before aUthorizing
the workshop."
No report from the University Senate was made nor was a vote from the University
Senate announced. During the discussion on this motion various members
of the Assembly made the following points: SEARCH courses are poorly taught,
the courses are not valid as they do not search for truth, it is assumed
the courses have the approval of the University, SEARCH courses compete
with legitimate University offerings, and SEARCH courses do not S force
students to ask questions on legitimate basis or to develop inquiry skills
as the regular University curriculum does. In opposing the motion the following
points were made: The University requires a disclaimer on all SEARCH publications
that it is not a part of the regularly recognized University curriculum,
the motion would give authority over SEARCH outside of the ASUO who is
the sponsor of SEARCH, it is not the position of the University to protect
the gullible, the motion would provide prior restraint on irrational ;
thought, students should have the freedom to explore and examine a great
many subjects, even the bizarre. President Olum pointed out that SEARCH
was created by the University Assembly and thus was a creature of the Assembly
and that the motion would not suppress any courses as all it requires is
consultation. This does not mean that after the consultation the course
could not be offered by SEARCH. Ms. Lori Lieberman, SUAB, called for the
motion. The motion required a two thirds vote which it got when the voice
vote was heard. The motion on SEARCH was defeated by a vote of 20 in favor
and 26 opposed.
Mr. Robert Friedman, Parliamentarian, moved to adjourn. Prior to adjournment,
however, President Olum stated that a notice of motion was to be given
by Ms. Carolyn Forell, Chair, Student Conduct Committee. Ms. Forell read
the following notice of motion: "At the June meeting of the Assembly, I
will make a motion on behalf of the Student Conduct Committee to amend
the Code of Student Conduct by providing a show cause procedure, to be
used to facilitate the enforcement of sanctions meted by proper authority
under the code." A public hearing on the proposed procedure is scheduled
for the afternoon of Thursday, May 17, 1984, in room 101 of the Erb Memorial
Union. A complete copy of the proposed amendment, Section 571-21-071 is
attached to these minutes as Appendix II.
ADJOURNMENT The motion to adjourn passed by a substantial margin at

APPENDIX I: DEFINITION OF VOTING FACULTY
Effective June 6, 1984 voting members of the University Assembly shall
include the following:

1.All tenured and emeritus faculty.
-
2.
-
a. All Full-time Instructors, Senior Instructors, Assistant Professors,
Associate Professors, and Professors on regular full-time academic appointment
as Officers of Instruction at the University of Oregon.
-
b. All Instructors 0.50 FTE or more in their fifth or later years on regular
academic appointment as officers of Instruction at the University of Oregon.
-
c. The Head of the Department of Military Science on issues directly affecting
the Department of Military Science.
-
3. All Senior Research Associates.
-
4. All Librarians in the University will have the same voting rights and
privileges as the faculty on regular academic appointment.
-
5. The President, vice-presidents, Provost, Vice Provosts, Deans and Associate
Deans, as well as Officers of Administration not regularly engaged in full-time
teaching, with the rank of Assistant Professor or 9. higher.
-
6. The Athletic Director and all Head Coaches with the rank of Assistant
Professor and higher who have full-time appointments within the University.
-
7. The eighteen (18) members of the Student University Affairs Board.
-
8. All faculty members who have the franchise at the time of the adoption
of this motion (May 2, 1984) shall retain that franchise until they terminate
employment as members of the faculty.

9. The following are EXCLUDED from the category of voting members (please
see below for a definition of these EXCLUDED categories where it is not
obvious), Adjunct, Visiting, or Courtesy appointees, Research Associates,
Research Assistants, Instructors who do not qualify under 2.b. above, and
Lecturers. Assistant Deans are excluded unless they qualify under another
category.

10. Faculty members who are voting members of any department or other minor
faculty in which they hold current budgeted appointments. This does not
prevent departments or other minor faculties from increasing the franchise
at the local level (such as Instructors not yet in their fifth year, other
students, etc.).
Definitions of Excluded categories where not obvious:
"Adjunct" is a person who holds a position outside the University (e.g.,
physicians, architects, social workers, etc.) who are employed to teach
on an occasional, part-time basis.
"Visiting" is a title accorded to faculty members who come to the University
to fill a temporary vacancy for a period of one year or less; or in certain
exceptional cases to a faculty member who is at the University for a one
year trial service while consideration is given to making that person a
permanent offer.
"Courtesy" appointments include persons given titles of regular academic
rank who have appropriate academic credentials, who are on leave from or
retired from a comparable institution, and who work as visitors in a University
department without compensation; to faculty members of a department who
contribute actively to another department of the University which wishes
to include such individuals in its departmental listing; to persons with
appropriate academic qualifications who contribute without stipend to field
work programs away from campus. In all cases, the title awarded is to he
consistent with the academic attainments of the individual for whom the
courtesy title is sought. (Through historical errors, the word "adjunct"
is used in some cases to describe what is defined above as a "courtesy"
appointment. Effort is in progress to correct the titles for the individuals
involved.)"
APPENDIX I Show Cause Proceedings
571-21-071 To enforce timely completion of sanctions imposed under this
Code, a routine review of cases involving delinquency in compliance is
provided by the show cause proceedings described below.
(1) Prior to the end of each term, the coordinator of Student Conduct shall:
-
(a) Appoint a hearings officer to hear all pending cases involving the
alleged violations of section (16) of 571-21-030 of the Student Conduct
Code;
-
(b) Set a date, time, and place for the show cause hearing so that it will
occur prior to the beginning of classes for the next succeeding academic
term (summer term excepted);
-
(c) Notify all student accused of sanction delinquency of the hearing date,
time, place and advise them of their right to contest the matter and their
right to be represented as provided by 571-21-010 (1) (d).
-
(2) Procedures for show cause hearings differ from other contested hearings
provided for in this Code:
-
(a) The right of peremptory challenge is not granted;
-
(b) Explicit authority is granted the hearing officer to rule on a case
* Pt involving a properly notified defendant who is not present for the
hearing;
-
(c) The disposition of a show cause proceeding is enforceable pending the
outcome of a successful appeal.
-
(3) The Director of the Office of Student Advocacy shall appoint counsel
to represent all defendants, not otherwise represented, who have been requested
to show cause at any given hearing scheduled for that purpose.
-
(4) A University appointed prosecutor will represent the University in
these show cause proceedings. The prosecutor shall:
-
(a) Receive pertinent case files from the coordinator of Student Conduct
-
(b) Answer questions about the files posed by either the hearings officer,
the defendants; or their counsel
-
(c) State, explain, and advocate the University's recommendation for disposition
of each case.
-
(5) After receiving, the University's recommendation and providing the
defendant an opportunity to show cause. the hearings officer shall
-
(a) Block pr cancel the student's registration, until the delinquent sanction
has been completed including any portion of it suspended on condition of
timely performance.
-
(b) Order that a negative notation be made on the student's transcript
until the delinquent sanction is fulfilled;
-
(c) Grant the student an extension of time to complete the delinquent sanction
with the option of meeting additional sanctions for the delinquency (d)
Find the student has satisfactorily completed the sanction and dismiss
the charge.
