Motion US9900-5 Access to Legal Counsel

Motion: Moved that the Faculty (``tenure track'' and ``teaching faculty'') at the University of Oregon should have access to legal counsel related to issues of University business that arise in connection with performance of duties and responsibilities as faculty members. Such legal access will be analogous to that now available to the Adminstration.

Background Information. The approximately 650 ``tenure track'' faculty members and the more than 1000 ``teaching faculty'' at the University of Oregon have no access to legal counsel in connection with issues that arise in connection with their teaching-research duties and responsibilities. Access to Melinda Grier, presently legal counsel to University is not available to faculty except through the appropriate Vice Presidents and then only ``on assignment'': Provost Moseley (for academic matters), Vice President Williams (for matters related to physical plant), and vice President McDonald (for matters related to fundraising and community service). This access, as noted, is conditional -- the vice presidents determine which questions they want Ms. Grier to spend time on. This motion, if approved, will attempt to redress this gross inequity and make legal counsel as available to faculty members as it is to the administration, without having to seek permission through one of the vice presidents with the likely possiblity that that permission will be denied.

Action postponed indefinitely owing to the untimely death of Senator Gray.
